Subscription Agreement

Welcome to use Call Recorder(hereinafter referred to as "Call Recorder" or "this application"). To protect the rights and interests of users (hereinafter referred to as "you"), please carefully read all the contents of this service agreement (hereinafter referred to as "this agreement") before using the subscription service of this application, especially the bolded parts.


Automatic Renewal Agreement for Members

The automatic renewal function is provided by the owner of Call Recorder for users to automatically deduct the fees from your designated third-party payment account or bank account according to your settings.

Please carefully read and fully understand the contents of each clause of this agreement, especially the corresponding clauses for exemption or limitation of liability. Call Recorder will prompt you to pay attention to the limitation and exemption clauses in the form of bold or italic bold. Minors should read this agreement under the accompaniment of their legal guardians and confirm that they have the right to bind other paid accounts.

By confirming the activation of the automatic renewal function, you are deemed to have read and agreed to be bound by this agreement. If you have any objections to any clause of this agreement, please immediately stop activating this function.

 

1. Service Content

1.1. To help you purchase (or subscribe to) the paid products of Call Recorder more conveniently, we provide you with the automatic renewal function. When you explicitly agree to activate the automatic renewal function, you authorize Call Recorder to deduct the fees required to purchase the paid product again from your bound third-party payment account or bank account when the agreed renewal conditions are met. The prerequisite for the realization of this function is that you have activated the automatic renewal and bound the relevant accounts, and the sufficient funds can be deducted from the above accounts successfully.

 

1.2. This function applies to the products provided by Call Recorder that require regular renewal, such as continuous weekly packages and continuous annual packages.

 

2. Activation of Automatic Renewal

2.1. After you activate the automatic renewal function, your Call Recorder account will be bound to your designated third-party payment account or bank account.

 

2.2. After you activate the automatic renewal function, you are deemed to know and agree that Call Recorder will issue a deduction instruction according to the deduction rules of the payment channel when the service period of the product is about to expire, and agree that the payment channel can deduct the fees for the next billing cycle from the account without verifying the information such as your account password, payment password, SMS verification code, etc., and extend the corresponding service content, service conditions, and service period.

 

2.3. You acknowledge and agree that the update of the automatic renewal status may be delayed, and the renewal status displayed in Call Recorder shall prevail.

 

2.4. If the renewal fails due to reasons not attributable to Call Recorder (such as third-party system failures, account limits, insufficient account balances, etc.), we will handle it as "expiration without renewal" and stop providing you with the corresponding services. You shall bear the possible adverse consequences.

 

2.5. Some Apple users can still purchase paid products without logging in to the Call Recorder account. In such cases, we will record the purchase according to the device (IMEI code) used by the user when purchasing the product, and bind the third-party payment account or bank account to the device. If you purchased the paid product without logging in to the Call Recorder account, but the device is no longer under your control, including but not limited to loss or giving it to others, you can close the automatic renewal to avoid continuous payment. For the closing method, see "Close Automatic Renewal" in this agreement.

 

3. Preferential Activities and Discounted Prices

We may adjust the product prices from time to time according to business needs or market conditions and publicize them to users on the payment interface. Except for the case where the prices for each period have been clearly agreed when both parties activate the automatic renewal function for the corresponding product, if the price at the time of automatic renewal is higher than the price when you initially purchased it, we will obtain your separate consent. If the price at the time of automatic renewal is lower than the price when you initially purchased it, we will directly deduct the corresponding amount.

 

4. Close Automatic Renewal

4.1. We will remind you of the automatic renewal matter in a prominent way (such as in-app private message, SMS, or Jiguang push notification, etc.) five days before the automatic renewal date. In addition, your subscription payment channel will also notify you in advance of the automatic deduction matter, and you can choose whether to renew or cancel the renewal independently. During the period when you use the product with the automatic renewal activated, you can also cancel or change the automatic renewal function at any time according to the options in the following path, and we will not charge you unreasonable fees for this.

 

4.2. You can close the automatic renewal function from the third-party payment account or bank account (or system). The closing path is as follows:

· For Apple devices: "App Store" on the Apple mobile device → Click on the Apple account avatar in the upper right corner, enter "Account" → "Subscriptions" → Select "Call Recorder" → Cancel Subscription;

 

4.3. If the path adjustment due to the upgrade of the device operating system or other reasons makes it impossible for you to close the automatic renewal correctly, you can consult the device manufacturer or system service provider, or contact our customer service by email (dodotoolsvip@163.com), and we will try our best to provide you with a solution.

 

4.4. Closing this function means that you revoke the authorization given to Call Recorder to automatically deduct the fees from the third-party payment account or bank account. However, this revocation does not affect the deductions already completed by Call Recorder before your successful revocation.

 

4.5. For whatever reason, if you terminate the use of the corresponding paid product service, the corresponding activated automatic renewal function needs to be closed by you manually. If you do not close it, Call Recorder will normally perform the automatic deduction operation, and once the deduction is successful, Call Recorder will normally extend the corresponding service for you.

 

5. Agreement Modification

5.1. According to the development of the Internet and the changes in relevant laws, regulations, and normative documents, or due to the needs of the business development of Call Recorder, Call Recorder has the right to modify or change the terms of this agreement. Once the content of this agreement changes, Call Recorder will prompt you according to the actual situation by choosing methods including but not limited to system prompts, announcements, and in-app messages.

 

5.2. If you do not agree to the modifications made by Call Recorder to the relevant clauses of this agreement, you have the right to close the automatic renewal. If you continue to use it, you are deemed to accept the modifications made by Call Recorder to the relevant clauses of this agreement.

 

6. Applicable Law and Dispute Resolution

6.1. The formation, entry into force, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland of the People's Republic of China. If any provision of this agreement is invalid due to its conflict with the laws of the mainland of the People's Republic of China, these provisions will be reinterpreted in accordance with the purpose of the original provisions of this agreement as closely as possible, and other provisions of this agreement shall still have full validity and effect.

 

6.2. In the event of a dispute between you and Call Recorder, both parties shall try to resolve it through friendly negotiation. If the negotiation fails, both parties agree to submit the dispute to the court with jurisdiction.
